We generate and deliver consumer inquiries (“leads”) based on targeted advertising campaigns.
Lead Delivery
Leads may be delivered via:
- CRM systems
- Email
- Secure dashboards
- Third-party integrations
Clients are responsible for:
- Accessing leads
- Contacting consumers
- Managing follow-ups
Exclusivity
Unless otherwise agreed in writing:
- Each lead is delivered on a single-client exclusive basis at the time of assignment
- Leads are not resold to multiple clients simultaneously
- Exclusivity applies only at the time of delivery
Lead Nature & No Guarantee
We do NOT guarantee:
- Loan approvals
- Conversion rates
- Revenue or profit
- Consumer eligibility or creditworthiness
Lead performance depends on:
- Client response time
- Sales process
- Market conditions
- Consumer financial profile
Lead Replacement Policy (7 Days)
Eligible Replacement Cases
- Duplicate submissions
- Invalid or non-working contact information
- Spam or bot submissions
- Clearly fraudulent entries
Requirements
- Must be reported within 7 days of delivery
- Reasonable proof required (screenshots, logs, email bounce, call attempts)
Not Eligible
- No answer / unresponsive leads
- Not interested consumers
- Poor credit or qualification mismatch
- Delayed follow-up by client
Acceptable Use
Clients agree to:
- Use leads only for lawful mortgage-related purposes
- Not resell or redistribute leads
- Comply with CASL (Canada), TCPA (USA), and applicable laws
- Maintain confidentiality of consumer data
Payments
- Subscription-based billing unless otherwise agreed
- Payments are non-refundable except under replacement policy
- Non-payment may result in suspension or termination
Communication Compliance
Clients acknowledge responsibility for:
- Proper calling/texting practices
- Compliance with consent laws (CASL/TCPA)
- Respecting opt-out requests
Third-Party Tools
We are not responsible for:
- Third-party CRM failures
- Email/SMS delivery issues
- External platform downtime
Intellectual Property
All systems, branding, processes, and technology remain the property of CatchyLeads and may not be copied or redistributed.
Limitation of Liability
Catchy Leads (www.catchyleads.com) is not liable for:
- Lost profits or revenue
- Business opportunities
- Lead performance outcomes
- Actions taken by consumers or third parties
Termination
We may suspend or terminate service if:
- Terms are violated
- Payments fail
- Misuse of leads occurs
Changes to Terms
We may update these Terms at any time. Continued use means acceptance of updates.
